La identificación de la denominada dispersión epistemológica en las decisiones en bioderecho se evidencia en la incorporación crítica al materialismo, en particular, y a las nuevas formas de fisicalismo, ya que su base epistemológica se encuentra en un contexto mucho más amplio que la explicación unificadora de la relación mente-cerebro. De ahí que teorías de la argumentación adoptadas por autores como Wroblesky, Aarnio y Alexy identifican una doble exigencia en la justificación: por un lado, la llamada justificación interna, regulada por (...) la lógica a la hora de conectar las premisas o conectar los enunciados que forman parte del razonamiento judicial y, por el otro, la justificación externa, focalizada en los argumentos o razones utilizadas para justificar aquellas premisas o enunciados. El bioderecho implica reconocer que se plantea una crítica al materialismo y al fisicalismo, camino que ya la psicopatología recorrió para entender fenómenos como la intencionalidad, la interpretación de conductas humanas y los supuestos interpretativos de la arquitectura de la decisión jurídica.El estudioso del bioderecho debe identificar esos supuestos, muchas veces irreflexivos; ello implica dar razones acerca de la relación mente-cuerpo subyacente; de los elementos que componen la acción humana jurídicamente relevante; la configuración de los bienes humanos básicos involucrados en la litis en el bioderecho; elementos todos estos que hacen necesario repensar el estatuto cognoscitivo del derecho, en general, y del bioderecho, en particular. This book provides both an introduction to the philosophy of scientific modeling and a contribution to the discussion and clarification of two recent philosophical conceptions of models: artifactualism and fictionalism. These can be viewed as different stances concerning the standard representationalist account of scientific models. By better understanding these two alternative views, readers will gain a deeper insight into what a model is as well as how models function in different sciences. Fictionalism has been a traditional epistemological stance related to (...) antirealist construals of laws and theories, such as instrumentalism and inferentialism. By contrast, the more recent fictional view of models holds that scientific models must be conceived of as the same kind of entities as literary characters and places. This approach is essentially an answer to the ontological question concerning the nature of models, which in principle is not incompatible with a representationalist account of the function of models. The artifactual view of models is an approach according to which scientific models are epistemic artifacts, whose main function is not to represent the phenomena but rather to provide epistemic access to them. It can be conceived of as a non-representationalist and pragmatic account of modeling, which does not intend to focus on the ontology of models but rather on the ways they are built and used for different purposes. The different essays address questions such as the artifactual view of idealization, the use of information theory to elucidate the concepts of abstraction and idealization, the deidealization of models, the nature of scientific fictions, the structural account of representation and the ontological status of structures, the role of surrogative reasoning with models, and the use of models for explaining and predicting physical phenomena. Las comunidades indígenas en Colombia atraviesan un fuerte proceso de eliminación, que no es reciente, se inició en los tiempos de la colonia con la llegada de los españoles en el siglo XVI. Actualmente, estos pueblos siguen siendo objeto de saqueos y penetración a sus territorios para aprovecharse de sus riquezas naturales y de sus conocimientos milenarios. Así la estrategia de penetración ha seguido la diferencia colonial; perspectiva binaria que clasifica a los agrupamientos humanos en superiores- inferiores, desarrollados-subdesarrollados, cultos incultos (...) y en útiles e inútiles, desde esta máquina de clasificación se han subalternizado formas otras de pensar, de sentir, de imaginar, de relacionarse con la naturaleza, de sociabilidad, de ocio y de re-creación como humanos, lo que nos ha alejado y nos sigue alejando de una convivencia con fundamento en la interculturalidad y en la prevalencia de lo diverso como condición existencial. En la Roma clásica, para la época de la orden judicial privada, la jurisdicción fue privada, ejercida por árbitros; desde la Roma postclásica, época del conocimiento extraordinario, ha sido pública, con resurgimiento de la jurisdicción privada en la figura del arbitraje.

En el presente texto se sostiene que las categorías de primeridad, segundidad y terceridad —y las relaciones posibles entre ellas— revelan las operaciones lógicas de relación y ley en el trabajo de Charles Sanders Peirce. Para ello, se muestra su importancia a través de paralelismos con otras triadas del filósofo norteamericano. Para dicho propósito, el texto se divide el texto en tres momentos. El primer momento consiste en exponer la operación de la triada principal: primeridad, segundidad y terceridad. En esta (...) caracterización se pondrá especial énfasis en la descripción del tratamiento de lo indeterminado hecho por las operaciones de la ley y la relación en las categorías1. En segundo lugar, se reconstruye la operación peirceana de las tricotomías en el razonamiento lógico. Background and AimsEnd-of-life discussions can be difficult for seriously ill adolescents and young adults. Researchers aimed to determine whether completing Voicing My CHOiCES —a research-informed advance care planning guide—increased communication with family, friends, or health care providers, and to evaluate the experience of those with whom VMC was shared.MethodsFamily, friends, or HCPs who the AYAs had shared their completed VMC with were administered structured interviews to assess their perception of the ACP discussion, changes in their relationship, conversation quality, and whether (...) the discussion prompted changes in care. Open-ended responses underwent thematic analysis.ResultsOne-month post-completion, 65.1% of AYA had shared VMC completion with a family member, 22.6% with a friend, and 8.9% with an HCP. Among a sample of respondents, family and friends reported a positive change in their relationship with the AYA. Participant descriptions of the experience fell into five themes: positive experience, difficult experience, appreciated a guide to facilitate discussion, provided relief, and created worry/anxiety. Only 1 HCP noted a treatment change. Family, friends, and HCP did not think the AYA would have discussed EoL preferences without completing VMC.ConclusionsVMC has potential to enhance communication about ACP between AYA and their family and friends, though less frequently with HCPs. Participants reported a positive change in their relationship with the AYA after discussing VMC, and described experiencing the conversation as favorable, even when also emotionally difficult. El artículo se propone ofrecer un acercamiento a la concepción de filosofía que subyace al proyecto de una hermenéutica de la facticidad elaborado por Martin Heidegger entre 1919-1923. Esta aproximación se lleva a cabo a través del desarrollo que en la constitución de tal proyecto tiene el fenómeno de la ruina. La centralidad que este ocupa en el desarrollo temprano del pensamiento de Heidegger y, particularmente, en el curso del semestre de invierno de 1921/22, que lleva por título Interpretaciones fenomenológicas (...) sobre Aristóteles. Introducción en la investigación fenomenológica, permite hacer comprensible el sentido que para el joven Heidegger constituye la tarea de la filosofía en esta temprana etapa como hermenéutica de la facticidad. This paper delves into the deconstruction of the notion of responsibility, drawing a correlation with the process of decomposition of the concept of sovereignty as discussed by Derrida in his last research works. We explore Derrida’s consideration of absolute responsibility as no longer passing through the figure of the sovereign. Derrida’s thought takes its distance from the philosophical and hegemonic determination of the notion of responsibility, for the conceptual system of its axiomatic defines responsibility based on the sovereign individual’s freedom (...) and makes responsibility the effect of his power. Yet, this definition condemns ethics to failure, since it does not account for the other supposed in the idea of response. Derrida incorporates absolute singularity, and consequently secrecy, into the structure of responsibility, enabling thought to encounter the absolute other. The text outlines the influence of Nietzsche and Celan in Derrida’s thought and develops an approach that sees in his work the effort to create a poetic revolution in the history of philosophy and knowledge by opening thought to radical alterity. El proyecto inicial de Martin Heidegger, tal como aparece elaborado en los textos de sus lecciones tempranas entre 1919 y 1923, y como ha mostrado el ya clásico trabajo de Theodore Kisiel (1993), parece anticipar en cierto sentido algu- nas de las temáticas que se desarrollan de modo más sistemático en Ser y tiempo, la gran obra de 1927.

It is not yet clear which response behavior requires self-regulatory effort in the moral dilemma task. Previous research has proposed that utilitarian responses require cognitive control, but subsequent studies have found inconsistencies with the empirical predictions of that hypothesis. In this paper we treat participants’ sensitivity to utilitarian gradients as a measure of performance. We confronted participants (N = 82) with a set of five dilemmas evoking a gradient of mean utilitarian responses in a 4-point scale and collected data on (...) heart rate variability and on utilitarian responses. We found positive correlations between tonic and phasic HRV and sensitivity to the utilitarian gradient in the high tonic group, but not in the low tonic group. Moreover, the low tonic group misplaced a scenario with a selfish incentive at the high end of the gradient. Results suggest that performance is represented by sensitivity correlated with HRV and accompanied with a reasonable placement of individual scenarios within the gradient. (shrink)

In this essay I revise, based on the notion of the ‘enlightened ruler’ or mingzhu and his critique of the literati of his time, the common belief that Han Fei was an amoralist and an advocate of tyranny. Instead, I will argue that his writings are dedicated to advising those who ought to rule in order to achieve the goal of a peaceful and stable society framed by laws in accordance with the dao.

En su intervención en el debate alemán de finales del siglo XVIII sobre el significado de la ilustración, Moses Mendelssohn asigna a la ilustración (Auflkärung) y a la cultura (Kultur), componentes teórico y práctico respectivamente de la formación (Bildung) de un pueblo, una función de profilaxis recíproca. El desarrollo de cada una constituye el mejor medio para prevenir la corrupción que produce el mal uso de la otra. Dado que la “manera de destruir” de cada una se contrapone a la (...) de la otra, la felicidad de una nación depende de su avance equilibrado. Epistemic Utility Theory is often identified with the project of *axiology-first epistemology*—the project of vindicating norms of epistemic rationality purely in terms of epistemic value. One of the central goals of axiology-first epistemology is to provide a justification of the central norm of Bayesian epistemology, Probabilism. The first part of this paper presents a new challenge to axiology first epistemology: I argue that in order to justify Probabilism in purely axiological terms, proponents of axiology first epistemology need to justify a (...) claim about epistemic value—what I label ‘Downwards Propriety’—much stronger than any they have offered justification. The second part of this paper offers an argument that this challenge cannot be met: that there is no hope for providing a purely axiological justification of Downwards Propriety, at least given widely accepted assumptions about epistemic value. The process of evolution of thinking that ended up in the writing of this piece is unveiled throughout the present analysis. This is a sign of both waiver and restart; the opening for a new productive dimension in the career of one of the most important —and misunderstood— philosophers of the 20th century. (...) I argue that Husserl’s concept of position-taking, Stellungnahme, is adequate to understand the idea of second nature as an issue of philosophical anthropology. I claim that the methodological focus must be the living subject that acts and lives among others, and that the notion of second nature must respond to precisely this fundamental active character of subjectivity. The appropriate concept should satisfy two additional desiderata. First, it should be able to develop alongside the biological, psychological, and social individual development. Second, (...) it should be able to underlie the vast diversity of human beings within and across communities. As possible candidates, I contrast position-taking with two types of habit-like concepts: instinct and habitus, on the one hand, and customary habits, on the other. I argue that position-taking represents the active aspect of the subject while the habit-like concepts are passive. A subject’s position-takings and ensuing comportments are tied together by motivations, which evince a certain consistency, and for this reason are expression of the subject’s identity. I conclude by nuancing the relation between Stellungnahme and passivity. Passivity is deemed necessary to action but subservient to it; position-taking is thought to be prior to passivity. (shrink)

This paper deals with the question of whether uncertainty regarding model structure, especially in climate modeling, exhibits a kind of “chaos.” Do small changes in model structure, in other words, lead to large variations in ensemble predictions? More specifically, does model error destroy forecast skill faster than the ordinary or “classical” chaos inherent in the real-world attractor? In some cases, the answer to this question seems to be “yes.” But how common is this state of affairs? Are there precise mathematical (...) results that can help us answer this question? And is dependence on model structure “sensitive” in that arbitrarily small errors can destroy forecast skill? We examine some efforts in the literature to answer this last question in the affirmative and find them to be unconvincing. (shrink)

Muchas y disímiles explicaciones se han propuesto para dar cuenta de lo que parece ser un fenómeno evidente en nuestro ámbito Cultural latinoamericano: la ausencia de la Filosofía. Algunas concepciones simplemente aseguran la inexistencia y, aun, la imposibilidad de una forma de "pensamiento filosófico" en esta parte del mundo cultural, mientras que otras afirman la imposibilidad de hablar de compartimientos geográficos en un "hacer" que se pretende, por definición, de carácter universal.

El objetivo de este artículo es describir la percepción de riesgo y los factores de protección y de riesgo frente al consumo de sustancias psicoactivas legales e ilegales en estudiantes de la Universidad de Boyacá. Es un estudio cuantitativo y descriptivo de corte transversal, para el cual se tomó una muestra de 573 estudiantes que fueron seleccionados mediante muestreo estratificado probabilístico. El instrumento utilizado fue la encuesta sobre consumo de drogas, factores y percepción de riesgo en estudiantes universitarios (CODEU) diseñado (...) por Beverido, Salas, De San Jorge, Pavón, Blázquez, Gogeascoechea y Cruz (2012), que consta de 73 preguntas. Este instrumento fue validado y obtuvo un alpha de Cronbach de 0.787. Los hallazgos muestran que entre los factores protectores se encuentran: adecuadas relaciones familiares y practicar un deporte, como factores de riesgo se identifican principalmente: la permisividad social y las construcciones de reconocimiento social presentes ante el consumo de sustancias legales. De las sustancias ilegales, la marihuana es la que se percibe como de menor riesgo frente a la cocaína, el bazuco, los inhalantes y la heroína. (shrink)

Proponents of enactivism should be interested in exploring what notion of action best captures the type of action-perception link that the view proposes, such that it covers all the aspects in which our doings constitute and are constituted by our perceiving. This article proposes and defends the thesis that the notion of sensorimotor dependencies is insufficient to account for the reality of human perception, and that the central enactive notion should be that of perceptual practices. Sensorimotor enactivism is insufficient because (...) it has no traction on socially dependent perceptions, which are essential to the role and significance of perception in our lives. Since the social dimension is a central desideratum in a theory of human perception, enactivism needs a notion that accounts for such an aspect. This article sketches the main features of the Wittgenstein-inspired notion of perceptual practices as the central notion to understand perception. Perception, I claim, is properly understood as woven into a type of social practices that includes food, dance, dress, music, etc. More specifically, perceptual practices are the enactment of culturally structured, normatively rich techniques of commerce of meaningful multi- and inter-modal perceptible material. I argue that perceptual practices explain three central features of socially dependent perception: attentional focus, aspects’ saliency, and modal-specific harmony-like relations. (shrink)

Recently, it has been proposed to understand a logic as containing not only a validity canon for inferences but also a validity canon for metainferences of any finite level. Then, it has been shown that it is possible to construct infinite hierarchies of "increasingly classical" logics—that is, logics that are classical at the level of inferences and of increasingly higher metainferences—all of which admit a transparent truth predicate. In this paper, we extend this line of investigation by taking a somehow (...) different route. We explore logics that are different from classical logic at the level of inferences, but recover some important aspects of classical logic at every metainferential level. We dub such systems meta-classical non-classical logics. We argue that the systems presented deserve to be regarded as logics in their own right and, moreover, are potentially useful for the non-classical logician. (shrink)

Este artículo se propone analizar las “trampas” de la comunidad en la perspectiva de Bourdieu. Para ello, primero, se señala el legado de Tönnies para la sociología respecto del vínculo entre la comunidad y las relaciones desinteresadas (pasadas, escasas en el presente y emancipatorias futuras). Segundo, se rastrean las profundas críticas de Bourdieu a tal legado, desde su estudio del “interés por el desinterés” enmarcado en sus reflexiones sobre la dominación social y sus eufemismos. Esto se observa en su interpretación (...) tanto de las sociedades no modernas como del desinterés moderno del Estado, con pretensiones de universalidad (por ejemplo, en la lengua unificada y la educación), y de los campos autonomizados y desinteresados de bienes simbólicos, entre los cuales se incluye a la sociología. Por último, las “trampas” que la comunidad encierra emergen en las últimas obras de Bourdieu. Allí, él propugna una intervención política explícita en la cual aparecen tópicos comunitarios y del desinterés, por ejemplo en su llamado a la colaboración entre militantes e intelectuales. Entonces, se vuelve patente una tensión en el autor entre una sociología crítica y reflexiva y la emancipación social. Así, este artículo pretende contribuir a una teoría sobre la comunidad y la dominación social, que tiene implicancias sugerentes para la actualidad. (shrink)

Kirk is on the bridge of the Enterprise facing a dilemma. He's duty‐bound never to violate the Prime Directive. One way to address the problem of the Prime Directive is to follow the (...) criteria used by Vulcans: reason and logic. This approach has been highly revered in the history of moral philosophy, and was most convincingly articulated by Immanuel Kant. Confucius and Aristotle would agree that while the Prime Directive is usually correct, there will be cases where it's wrong not to break it. This article focuses on the role played by the critique of political economy and Marxian philosophy in the redefinition of Gramsci’s political philosophy during his intellectual moment known as the “return to Marx’’. On the one hand, we show the theoretical importance of the concept of mercato determinato in the formation of notions such as “civil society” and “relations of forces”. On the other hand, the Italian philosopher’s prison revisitation of some of Marx’s works are evaluated; as well as its (...) effects on the revision of certain topics such as the relationship between structure-superstructure or the theory of hegemony. Through an original interpretation of the critique of political economy; and also re-examining the theoretical principles of “historical materialism” in a “philosophy of praxis”, the final aim is to present an interpretation of Gramscian social ontology able to provide a theory on the genesis, reproduction and crisis of a given social formation. El presente artículo evalúa la legislación argentina sobre servicios de comunicación audiovisual a partir de la teoría política republicana. El abordaje se centró en dos normas de nivel federal: la Ley de Servicios de Comunicación Audiovisual (Ley 26.522) y el Decreto 267/2015. Este trabajo se enmarca en la filosofía práctica de orientación analítica y los métodos utilizados son el equilibrio reflexivo y el análisis conceptual. De esta manera, se hizo una breve reconstrucción del concepto de libertad republicana para, a partir (...) de allí, establecer qué barreras institucionales establece esta tradición y qué marcadores indican el funcionamiento de estas barreras. Luego, se usaron estos marcadores para medir el cumplimiento de las exigencias de esta teoría por parte de la legislación argentina en materia audiovisual. Tras un abordaje de estas instituciones, se concluyó que las normas sancionadas por el gobierno nacional de Cambiemos implicaron un retroceso en términos republicanos. (shrink)

Despite impressive technological developments, there is something that does not seem to have changed in the future of the Alien saga: capitalist society. The capitalist mode of production was largely triggered by an important event in the history of humanity: the Industrial Revolution. In the Alien films the worst tendencies of capitalism seem to drive the Weyland‐Yutani Corporation's decisions, confirming Karl Marx's fears that people would not be at the center of the process of capitalist production. It is clear the (...) Weyland‐Yutani Corporation has taken its goal of acquisition of profit at all costs very seriously, as demonstrated by Special Order 937. Alienation is one of Marx's key ideas. This chapter mainly focuses on alienation as it is described in a series of notebooks written in 1857‐1858, also known as the Grundrisse. Marx concludes, based on insights from ancient Greek and Hellenistic philosophers, that the good life should be one of active self‐realization and autonomy. (shrink)

Argumentation represents a way of reasoning over a knowledge base containing possibly incomplete and/or inconsistent information, to obtain useful conclusions. As a reasoning mechanism, the way an argumentation reasoning engine reaches these conclusions resembles the cognitive process that humans follow to analyze their beliefs; thus, unlike other computationally reasoning systems, argumentation offers an intellectually friendly alternative to other defeasible reasoning systems. LogicProgrammingisacomputationalparadigmthathasproducedcompu- tationallyattractivesystemswithremarkablesuccessinmanyapplications. Merging ideas from both areas, Defeasible Logic Programming offers a computational reasoning system that uses an argumentation engine (...) to obtain answers from a knowledge base represented using a logic programming language extended with defeasible rules. The thought of Pierre Klossowski, praised by Foucault, Blanchot, Deleuze, has been scarcely addressed by the philosophical community. We argue in this article that this is largely due to the frequent difficulty of understanding his work as a whole: both his artistic and literary production and his interpretations of Nietzsche or Sade form a coherent whole, whose significance has a deeply critical political scope. The notion of unproductive spending, which occupies a central place in Bataille's work, will be rearticulated in (...) Klossowski's reflections through the concepts of drive, phantasm, simulacrum, value and consumption. In The Living Currency, the political dimension of these terms appears clearly: relying on a rereading of Fourier and Sade, the author shows the extreme degree of deformation of what we assume as a reality in modern industrial society. In this sense, his thinking takes on special relevance today, as a revelation of the excess and unhingedness of a society in which production and consumption are reproduced without limit through the infinite reflections produced by the game between drives, ghosts and simulacra.
